Filing Post-Order Modifications to Account for Life Changes
In order to seek a modification of your order to pay child support, you must have experienced a financial change in circumstances since the date of your last order, or there is no proper basis for its modification. These changes can include:
- Loss of your job or significant decrease in pay
- Increase of your child's cost of care, including health care and day care
- Your former spouse or partner may have remarried or found a new job
Time is particularly important when seeking a modification of your obligation to pay child or spousal support: if you lose your job but don't seek a modification for six months afterward, the adjustment will only take effect from the date of the modified order. Any payments not made in the meantime will go into arrearage and will not be adjusted to account for the modification.
